Membership Terms & Conditions

These Terms and Conditions form part of your membership agreement with InShape Health Club Manby (“InShape”, “we”, “us” or “the Club”).
By purchasing a membership and accepting these Terms and Conditions, you agree to comply with them together with the Club Rules and reasonable health and safety requirements in place at InShape.
1. Membership Agreement
Your membership is personal to you and cannot be transferred, shared or used by another person.
The membership type, price, payment arrangement and membership start date applicable to you will be shown within ClubRight or your membership confirmation.
Your membership begins on the membership start date recorded in ClubRight.
You are responsible for keeping your personal details and contact information within ClubRight accurate and up to date.
2. Membership Options
InShape Health Club Manby currently offers the following membership options.
Rolling Monthly Membership
An ongoing monthly membership which continues until cancelled in accordance with these Terms.
Rolling Monthly Memberships may be cancelled by providing 30 days’ notice.
One-Month Membership
A fixed membership for one month.
The membership ends automatically at the end of the agreed one-month period and does not automatically renew unless a new membership is purchased or otherwise agreed.
6-Month Membership
A fixed membership for six months.
Unless otherwise stated at the time of purchase, the membership is paid in full at the point of purchase.
The membership ends automatically at the end of the agreed six-month period and does not automatically renew unless a new membership is purchased or otherwise agreed.
12-Month Membership
A fixed membership for 12 months.
Unless otherwise stated at the time of purchase, the membership is paid in full at the point of purchase.
The membership ends automatically at the end of the agreed 12-month period and does not automatically renew unless a new membership is purchased or otherwise agreed.
The membership type, price and terms applicable to you will be those presented and agreed when you purchase your membership.
3. Payments
Monthly membership payments will be collected using the payment method agreed when you join.
You are responsible for ensuring that valid payment details are maintained and that sufficient funds are available when payments become due.
Cancelling your Direct Debit or other payment instruction does not cancel your membership or remove your responsibility to pay any membership fees properly due.
If a payment is missed or becomes overdue, InShape may contact you to request payment and may temporarily suspend your Club access until the outstanding balance has been resolved.
Where an outstanding balance remains unpaid after reasonable attempts have been made to resolve the matter, InShape reserves the right to refer the outstanding debt to a third-party debt recovery provider and/or take appropriate legal action to recover sums properly due under the membership agreement.
You may also be responsible for reasonable recovery costs where these are lawfully recoverable.
If you are experiencing genuine difficulty making a payment, we encourage you to contact InShape as soon as possible so the circumstances can be considered before the matter is escalated.
Membership prices may be reviewed from time to time. Rolling Monthly members will receive at least 30 days’ notice of any price increase affecting their membership.
A price change will not retrospectively alter the amount already paid for an existing fixed-term membership.
4. Cancelling Your Membership
Rolling Monthly Membership
Rolling Monthly Memberships may be cancelled by providing 30 days’ notice.
Cancellation must be submitted through ClubRight or another written method accepted by InShape.
Your membership remains active during the notice period and any membership payment properly falling due during that period remains payable.
Cancelling your Direct Debit or payment instruction does not by itself constitute cancellation of your membership.
One-Month, 6-Month and 12-Month Memberships
These memberships are purchased for the full agreed membership period and will normally end automatically at the end of that period.
They are not normally refundable once they have commenced.
We understand that circumstances can change. Requests for early cancellation or a partial refund may be considered in genuine exceptional circumstances, including serious illness, significant injury, permanent relocation or another substantial change in circumstances.
We may request reasonable supporting information and each request will be considered fairly and individually.
Nothing in these Terms affects any statutory rights you may have as a consumer.
5. Club Access
Members are granted access to InShape in accordance with the access arrangements applicable to their membership.
Any access code, fob, QR code or other entry credential provided to you is personal to you.
You must not:
- Share your membership or access credentials with another person.
- Allow a non-member to enter using your membership.
- Deliberately allow another person to follow you into the Club without authorised access.
- Attempt to bypass or interfere with the Club’s access or security systems.
Allowing unauthorised access is considered a serious breach of membership and may result in suspension or termination.
CCTV may operate within and around the premises for safety, security and crime-prevention purposes.
6. Unstaffed Access & Member Responsibility
InShape Health Club Manby may operate without staff being present during certain hours.
By joining and choosing to use the Club during unstaffed hours, you acknowledge that staff may not be immediately available to assist you.
During these periods, you are responsible for:
- Exercising within your own ability and experience.
- Using equipment appropriately and for its intended purpose.
- Following all Club Rules, safety guidance and displayed instructions.
- Familiarising yourself with emergency exits and emergency procedures.
- Not using equipment or undertaking exercises that you are not confident you can perform safely.
Any damaged equipment, hazard, accident or safety concern should be reported to InShape as soon as reasonably possible.
Nothing in these Terms excludes or limits any responsibility InShape has where liability cannot legally be excluded.
7. Club Rules & Conduct
We want InShape to remain a safe, welcoming and enjoyable environment for everyone.
Members are expected to:
- Treat other members, staff and visitors with respect.
- Use equipment responsibly and for its intended purpose.
- Return weights, attachments and equipment after use.
- Keep training areas tidy.
- Wipe down equipment where appropriate.
- Follow reasonable hygiene standards.
- Wear appropriate training clothing and footwear.
- Follow safety signage and reasonable instructions from InShape staff.
- Respect the privacy and personal space of other members.
- Avoid threatening, abusive, discriminatory, intimidating, dangerous or disruptive behaviour.
- Respect Club equipment, property and facilities.
Serious or repeated breaches of Club Rules may result in suspension or termination of membership.
8. Facilities & Club Operations
InShape aims to provide a high-quality and well-maintained training environment.
From time to time, individual pieces of equipment, facilities or areas of the Club may be temporarily unavailable because of maintenance, repair, cleaning, replacement, improvements, safety requirements or circumstances outside our reasonable control.
We may also make reasonable changes to equipment, layouts, services or Club operations as the Club develops.
Temporary unavailability of an individual facility or piece of equipment will not normally entitle a member to a refund.
Where a significant long-term change materially affects the membership service you have contracted to receive, we will consider the circumstances fairly and in accordance with applicable consumer law.
9. Suspension or Termination
InShape may temporarily suspend membership access where reasonably necessary because of:
- Overdue membership payments.
- A serious safety concern.
- Suspected unauthorised access.
- Serious or repeated breaches of Club Rules.
- Threatening, abusive or inappropriate behaviour.
- Deliberate damage or theft.
Where appropriate, we will seek to resolve minor issues with the member before terminating membership.
Serious misconduct may result in immediate suspension or termination.
Where membership is suspended or terminated because of a member’s breach, any sums properly due under the membership agreement remain payable.
10. Health & Safety
You are responsible for exercising appropriately for your own health, ability and experience.
You must follow all health and safety guidance, Club Rules and instructions applicable to the equipment and facilities you use.
Separate health declarations, PAR-Q forms, waivers or facility-specific safety guidance may also apply.
If you are unsure whether you are medically suitable to exercise or use a particular facility, you should seek appropriate professional medical advice.
Any accident, hazard or damaged equipment should be reported to InShape as soon as reasonably possible.
11. Liability
Nothing in these Terms excludes or limits InShape’s liability for death or personal injury caused by our negligence, fraud or any other liability which cannot legally be excluded or limited.
Members remain responsible for exercising appropriately, using equipment correctly and following reasonable safety instructions.
InShape will not be responsible for injury, loss or damage resulting from a member’s deliberate or negligent misuse of equipment or facilities, failure to follow reasonable safety instructions, or circumstances for which InShape is not legally responsible.
Members are responsible for their own personal belongings while using the Club.
Nothing in these Terms affects your statutory rights.
12. Privacy & Personal Data
We process personal information in accordance with applicable UK data protection legislation and our Privacy Policy.
This may include information required to administer your membership, process payments, manage Club access, communicate with you, maintain safety and security and operate the Club.
Our Privacy Policy explains what information we collect, how and why we use it, who it may be shared with, how long it may be retained and your rights in relation to your personal information.
Essential communications relating to your membership, payments, access, safety or Club operations are separate from optional marketing communications.
13. Changes to These Terms
InShape may update these Terms where reasonably necessary because of changes to legislation, Club operations, facilities, services or other legitimate business reasons.
We will not make arbitrary or unfair changes to an existing membership agreement.
Where a change materially affects an existing member’s rights or obligations, we will provide reasonable notice through ClubRight, email or another appropriate method.

These Terms are governed by the laws of England and Wales.
